Have you been posted to Norway?

If your employer sends you to Norway on a work assignment, you have for the most part the same rights as Norwegian workers. This also applies if you are employed by a temporary work agency or by a corporate group and are posted to a division in Norway.

As a worker posted to Norway, you are entitled to the following from your employer:

It is your employer who has the main responsibility for your health and safety, and who must ensure that you use protective equipment. If there are several undertakings at the same workplace, it is the Norwegian principal enterprise that is responsible for coordinating work on health, safety and the environment (HSE).

When there are two or more undertakings at the same workplace, it is the principal enterprise that is responsible for coordinating work on health, safety and the environment (HSE).

Pay, expenses and wage slips

You may at the outset have a wage level that applies in the country from which you have been posted. However, if you have a residence permit under the Immigration Act, the wage you are entitled to will be stated in the permit. If you are to work in an area covered by a generally applicable collective agreement, you are entitled to a wage in accordance with this collective agreement.

The General Application Regulations may also contain provisions concerning coverage of expenses for board and lodging and for journeys home.

If you work for a temporary work agency, you are entitled to the same pay and expenses as direct employees of the hiring enterprise.

In connection with your wage payments, your employer must provide you with a wage slip showing the method used for calculating the wage, the basis for calculation of holiday pay and deductions that have been made.

Making claims

If you do not receive the pay or holiday pay you are entitled to, you must make a claim to your employer in your home country. If your claim is not successful, you must take the claim to court or contact the authorities in your home country.

The Norwegian Labour Inspection Authority cannot help you to collect pay.

Notify the Norwegian Labour Inspection Authority

If you do not receive what you are entitled to, notify the Norwegian Labour Inspection Authority. You can do this anonymously.

The Norwegian Labour Inspection Authority can order your employer to pay you the correct wage in future, but cannot help you to recover outstanding pay.
