Section 175 b. Aggravated enforced disappearance

The penalty for aggravated enforced disappearance is a term of imprisonment not exceeding 21 years.
In determining whether an enforced disappearance is aggravated, particular weight shall be given to
  1. a.
    whether the aggrieved person, on account of the disappearance, dies or sustains considerable harm to his or her body or health,
  2. b.
    whether the aggrieved person was ill or injured, pregnant, was a minor, had a disability or was in some other way particularly vulnerable, or
  3. c.
    whether the aggrieved person suffered a physical assault committed by several people acting together or was raped.
